Partner Terms

The KARDZA Partner Referral Program is operated by Bratim BV, Koensborre 92, Bus 101, 1730 Asse, Belgium. Contact: support.kardza@gmail.com. VAT number: BE1000.750.582.

These terms govern your participation as a referral partner. They supplement the Terms of Service. For the Partner Program, these terms take priority if the documents conflict. Personal information is handled under our Privacy Policy.

1. Eligibility and acceptance

You must be at least 18, legally able to enter this agreement, and authorised to act for any organisation you represent. Participation requires approval by KARDZA, an active partner account, accurate account details, and acceptance of the current Partner Terms before using the Partner Portal. Partners are independent participants, not employees or agents authorised to bind KARDZA.

2. Referral tracking

Use your unique referral link or code. With the visitor’s optional Referral / affiliate tracking consent, our current tracking remembers a valid referral for up to 30 days in a signed first-party cookie. Refusing or withdrawing consent prevents device attribution storage and does not prevent signup. An existing valid, active referral takes priority over a later link or code. Tracking can fail if cookies are cleared or blocked, the period expires, or the visitor changes browser or device. Contact us promptly about a missing referral; we cannot promise attribution without reliable evidence.

Attribution is finalised for a new business through the signup flow and then remains permanently linked to its recorded partner under the existing referral rules, including during Beta. Existing businesses cannot be reassigned through a new referral link. Deactivating a partner does not erase historical attribution. Data retention and lawful deletion requests remain subject to the Privacy Policy.

3. Beta is free: no commission during the free period

KARDZA is currently in Beta and free for businesses. While a referred business uses KARDZA for free, no commission is earned, accrues, is payable, or is owed by KARDZA. There is no retroactive commission for the free Beta period.

Your referrals are tracked during Beta and remain attributed to you. If KARDZA introduces paid subscriptions and a referred business becomes a paying customer, commission eligibility begins with the first successfully collected paid subscription payment, subject to these terms. Creating an account, being active, selecting a paid plan, issuing an invoice, or starting a trial does not itself earn commission.

Example: you refer Salon A during Beta. It uses KARDZA free for three months: commission for those months is €0. Later it pays €20 per month in qualifying subscription revenue, excluding VAT or sales tax. From the first successful €20 payment, the 30% commission is €6 per qualifying payment. If €20 includes tax or is partly refunded, the qualifying base is lower. This example is not a promise of future pricing or income.

4. The 30% recurring commission

Partners are eligible to receive a 30% recurring commission on qualifying subscription revenue actually received by KARDZA from businesses attributed to that Partner.

Qualifying revenue excludes VAT and sales tax, refunded amounts, chargebacks, failed payments, credits, discounts and all amounts not actually collected. Commission applies to qualifying subscription payments, not account creation, free usage or projected revenue. It recurs as qualifying payments are collected, subject to these terms and any prospective program changes. There is no guaranteed conversion, minimum income or paid-launch date.

5. Refunds and chargebacks

Commission on refunded or charged-back amounts is not payable. If already counted or paid, the related commission may be reversed or deducted from future commission calculations. Partial refunds reduce the qualifying revenue proportionally. No commission is owed on unpaid or failed invoices.

6. Honest promotion and affiliate disclosure

When promoting KARDZA, Partners must clearly disclose that they may receive a commission from qualifying referrals. Make the commercial relationship easy to recognise alongside the promotion, in a way appropriate to the channel and applicable law.

You must not make false claims, promise unavailable features, impersonate KARDZA, use spam or unlawful marketing, create fake referrals, create self-referrals solely to obtain commission, or mislead people about pricing or commissions. Explain that KARDZA is free during Beta and that commissions only start on qualifying paid payments. Do not claim that you currently earn money from free accounts.

KARDZA may investigate and reject fraudulent, self-generated or abusive referrals and related commission claims. Use our branding accurately, respect intellectual property, and stop using promotional material we reasonably ask you to remove.

7. Your responsibilities and referral information

Protect your login details, keep your information accurate, comply with advertising and data-protection rules, and only use referral information to track and manage your referrals. The portal provides limited business information, not customer lists or unnecessary owner contact details. Do not scrape, sell or misuse that information.

8. Payouts and taxes

Payout processing may be manual. No automatic payout, bank transfer or fixed payout date is promised by these terms. Before paid subscriptions launch, KARDZA will communicate the practical payout process and timing. Eligible amounts remain subject to payment verification, refunds, chargebacks and reasonable fraud checks.

You are responsible for supplying correct payout and tax information and meeting your own tax obligations where applicable. KARDZA may request reasonable identity, business, tax or payment documents before paying commission and may make deductions required by law. Contact us about eligible unpaid amounts or payout questions. Nothing in this section creates commission for free usage.

9. Suspension and termination

You may leave the program by contacting us. KARDZA may suspend or end access for breach, fraud, abuse, security or legal reasons, or discontinue the program with reasonable advance notice where practicable. Stop presenting yourself as a current KARDZA partner when participation ends.

Historical referral attribution remains intact on deactivation. Valid commission earned before termination remains subject to verification and refund or chargeback adjustments; fraudulent claims are excluded. Deactivation alone does not reassign referrals or erase future eligibility of legitimate Beta referrals. Any prospective change to eligibility will be communicated under section 10.

10. Program changes

KARDZA may change or discontinue the program, including prospective commission rules. Material changes will be communicated with reasonable advance notice where practicable and a new terms version. Portal access will require acceptance of the current version. Changes will not retroactively create commission for free periods or remove valid commission already earned. Records of earlier acceptance are retained as described in the Privacy Policy.

11. Liability

To the extent permitted by applicable law, Bratim BV is not liable for indirect or consequential losses, including speculative future commissions. Tracking and service availability are not guaranteed to be uninterrupted or error-free. Nothing excludes liability that cannot lawfully be excluded or removes an obligation to pay valid earned commission under these terms. VAT number: BE1000.750.582.

12. Governing law and contact

These terms are governed by Belgian law, subject to mandatory legal rights. Disputes are subject to the jurisdiction of the competent courts under applicable law; no mandatory forum rights are excluded.
